These Terms govern your use of NudgePay (the "Service"), operated by Mohamed Amine Boughattas, sole proprietor, trading as NudgePay ("we", "us"). By using the Service you agree to these Terms.
1. The service
NudgePay helps freelancers and small agencies track unpaid invoices and automate polite reminder sequences. We provide the Service "as is" and do not guarantee uninterrupted or error-free performance.
2. Your account
You are responsible for keeping your login credentials confidential and for any activity under your account. You must provide accurate information and keep it up to date.
3. Acceptable use
- No unlawful use, fraud, or spam
- No infringement of intellectual property rights
- No probing, scanning, scraping, or interference with our security
- No reverse engineering or circumvention of technical limits
4. Intellectual property
We retain all rights to the Service, including software, documentation, and branding. You receive a limited, non-exclusive, non-transferable right to use the Service within your selected plan.
5. Payment and subscription
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. For payment, billing, tax, cancellation, and refund mechanics, see Paddle's Buyer Terms.
6. Suspension and termination
We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated policy violations. On termination, you may export your data within 30 days, after which it may be deleted.
7. Liability
To the fullest extent permitted by law, we exclude implied warranties. Our aggregate liability is capped at the fees paid by you to us in the prior 12 months. We exclude liability for indirect, consequential, or special damages.
8. Governing law
These Terms are governed by the laws of Germany, and the courts of Berlin shall have exclusive jurisdiction over any disputes arising from or relating to these Terms.
